This is an agreement between you and CellShoppe, a professional smartphone fix and sales provider. It outlines the terms and conditions (the “Service Terms”) that apply to your use of CellShoppe’s products and services, including customer support, fix services for smartphones and electronic tablets (collectively, “Devices”), warranties and guarantees, trade-ins, and purchases of certified pre-owned Devices or accessories (collectively, the “Products and Services”). These Service Terms, along with our Privacy Policy and any additional terms presented at the time of service, form the agreement between you and CellShoppe (the “Agreement”).
By using our Products and Services, you agree to the terms of this Agreement. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OUR SERVICES.
CellShoppe reserves the right to amend the Agreement, including service terms and pricing, with 45 days’ notice. You will be notified of any updates via our website www.cellshoppe.ca. Your continued use of our services after such notice will be deemed as acceptance of the updated terms.
CellShoppe Service Terms & Conditions
1. What CellShoppe Provides
a) Fix Services and Quotes
CellShoppe will make all reasonable efforts to fix your device with utmost care and professional skill. Before performing any fixes, CellShoppe will provide you with a quote estimating the fix cost based on the information you provide. Once you accept the quote, we will proceed with the fix. If the actual cost of the fix exceeds the quoted price, CellShoppe will obtain your consent before continuing with the service. Any time estimate provided for fix completion is approximate and does not form a binding obligation under these Service Terms.
All fix quotes exclude applicable taxes. Quotes are valid only on the day they are issued, as prices may vary.
Once your device is fixed and ready for collection, CellShoppe will notify you through your preferred method of contact.
b) Fix and Device Financing
Any electronics like phone and laptop fix and device financing at CellShoppe is available through Paypal. All financing terms are governed by your agreement with Paypal. CellShoppe is not responsible for any financing terms, agreements, or payment obligations.
c) Guarantees and Warranties
CellShoppe’s head office is located at: 15803 87 Ave NW, Edmonton, AB T5R 4G7, Canada.
(i) Fix Services Guarantees
What is Covered
Unless otherwise stated, CellShoppe provides 90-days guarantee on fixes not covered by an OEM or extended warranty program, subject to these Service Terms.
What is Not Covered
Fixes completed under OEM or extended warranty programs.
Additional faults unrelated to the original fix or any post-fix damage.
Screen replacements needed due to water damage or physical surface damage, such as cracks or scratches on LCD screens or camera lenses.
Claims Procedure
Bring your device to any CellShoppe location for diagnostics if it fails during the guarantee period. If the issue falls within the scope of the guarantee, we will fix it at no extra cost. If the initial fix was done through our mail-in service, you may opt for mail-in diagnostics under the guarantee terms. CellShoppe will cover return shipping for qualified mail-in guarantee claims.
Limitation
This guarantee does not apply if:
The serial number, IMEI, water indicator, warranty seal, or accessory code is removed, defaced, or altered.
The defect results from excessive wear and tear.
The defect is caused by rough handling, moisture, extreme conditions, corrosion, unauthorized fixes, or use of non-approved parts.
The battery was short-circuited, tampered with, or used improperly.
The issue is due to network function failures or required software upgrades.
The device was used with or connected to a faulty or unapproved accessory.
Transferability
The guarantee is included in the fix price and is non-transferable.
(ii) Warranty Terms & Conditions for Certified Pre-Owned Devices
What is Covered
CellShoppe offers 90-days limited warranty on Certified Pre-Owned (CPO) Devices for defects in materials and workmanship, subject to the terms below.
What is Not Covered
Software or peripheral equipment.
Liquid damage or physical surface damage such as scratches or screen cracks.
Claims Procedure
Bring your CPO Device and original receipt to any CellShoppe location for diagnostics. If fix is not possible due to part unavailability, CellShoppe will provide an equivalent replacement device (if available); or full refund.
Limitation
The warranty is void if:
The device exceeds its fiixable lifespan.
Identifying information is removed or damaged.
The defect arises from misuse, environmental exposure, unauthorized fix, or improper accessories.
The battery was tampered with or short-circuited.
Software failure is due to network configuration changes.
Transferability
The warranty is tied to the device’s IMEI and is transferable. It is not tied to the original buyer.
(iii) General Terms
CellShoppe’s Products and Services are provided “as is” and “as available.” Your use is at your own risk. To the extent permitted by applicable law, and unless otherwise stated, CellShoppe disclaims all express, implied, or statutory warranties and representations, including but not limited to warranties of merchantability, fitness for a particular purpose, or satisfactory quality.
TO THE EXTENT PERMITTED BY LAW, THE EXPRESS WARRANTIES, GUARANTEES, CONDITIONS, AND REMEDIES SET OUT IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, GUARANTEES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS, AND REPRESENTATIONS. CELLSHOPPE SPECIFICALLY DISCLAIMS ALL OTHER STATUTORY AND IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, SATISFACTORY QUALITY, CARE, SKILL, OR FITNESS FOR A PARTICULAR PURPOSE.
2. Online Purchases
a) Ordering Process
To make a purchase on the CellShoppe website, you may either create an account or check out as a guest. In either case, you must be of the age of majority in your province or territory of residence. You are required to provide certain personal details so your order can be processed accurately. You are responsible for keeping this information up to date.
b) Price
All prices are listed in Canadian dollars and all transactions will be processed in Canadian currency. Prices displayed on the website or through other communications from CellShoppe are subject to change without notice and do not include shipping fees or applicable sales tax. Shipping and taxes will be shown at checkout before you confirm your order.
c) Availability and Description of Products
Product availability on the website is not guaranteed. CellShoppe reserves the right to limit the quantities of specific products. Items placed in your shopping cart are not reserved until the order is completed.
While CellShoppe strives for accuracy in product descriptions and content, we do not guarantee that all information is current, complete, reliable, or error-free. If a product is not as described, your sole remedy is to return it in line with CellShoppe’s return policy.
d) Rejection or Cancellation of Orders
CellShoppe may cancel any order and issue a full refund due to pricing errors, inventory shortages, or for other reasons. If your order is rejected or canceled, CellShoppe will have no further obligation to fulfill it, and you will not be charged or will be refunded accordingly.
e) Payment
You can pay for your purchase using VISA, Mastercard, American Express, Paypal financing, or PayPal direct payment. By placing an order, you authorize CellShoppe to charge the payment method for the total amount due. You must be the account holder or authorized user of the payment method used. If your payment is declined, your order will not be processed or shipped. All billing information must be accurate and truthful.
f)Shipment
Your order will be shipped using a third-party courier. Once shipped, you will receive a confirmation email, and your payment method will be charged. Orders are fulfilled from multiple locations across Canada. CellShoppe does not ship to international addresses or freight forwarders. Estimated delivery times are not guaranteed and delays may occur. CellShoppe is not liable for any shipping delays.
g) Returns & Exchanges
At CellShoppe, we aim to ensure you’re satisfied with your purchase. If not, you may return or exchange eligible products if the following criteria are met:
(i) Proof of Purchase
You must present the original sales receipt or email confirmation.
(ii) Product in Original Condition & Packaging
The item must be in its original packaging and in the same condition as when purchased.
The following items are not eligible for return:
Accessories with earpieces or earbuds
SIM cards
(iii) Returned Within 90 Days of Purchase
- 90-Day Repair Warranty: If your Certified Pre-Owned (CPO) Device is found to be defective within 90 days of purchase, CellShoppe will provide a repair under warranty.
- How to Initiate: To initiate a repair, exchange, or return for store credit, you must directly book an appointment through the Get-a-Quote section on our website. Please note that we no longer process these requests via email.
- Online Purchases: Items purchased online may be processed in-store during your appointment or shipped back to CellShoppe at the buyer’s expense.
(iv) Device Passwords, Personal Data, and Locks Removed
Before returning your device, please remove all personal data (e.g., passwords, memory cards, and contacts). Once returned, the device cannot be accessed for data retrieval. CellShoppe is not responsible for any data left on returned items.
(v) Store Credit & Exchanges Only
All purchases are strictly non-refundable. Eligible returns will only be accepted for store credit or an exchange for another CPO device.
(vi) Gift with Purchase
If a free gift or promotional item was included with your purchase (e.g., gift card, accessory), it must be returned along with the item. If not returned, the value of the gift item will be deducted from your refund or exchange amount.
3. Your Responsibilities
a) Passcodes
CellShoppe requires the passcode of your Device to conduct complete fix services. If you prefer not to share your passcode, CellShoppe may proceed with diagnostics, but a full functionality check will be delayed until you are available in person at a CellShoppe store. This may result in a longer fixing timeline. For mail-in fixes, if we cannot complete full diagnostics due to a locked Device, you will be responsible for any additional shipping costs incurred.
b) Retention Policy
Once your Device has been fixed and is ready for pick-up, CellShoppe will notify you through your preferred contact method. If we cannot reach you initially, we will make reasonable efforts to follow up. However, CellShoppe is not responsible for any Devices not collected within 30 days from the first notification. After this time, CellShoppe may dispose of the Device at its sole discretion.
c) Data Backup
It is your sole responsibility to back up all data, files, software, and programs stored on your Device prior to submitting it for fix. CellShoppe assumes no liability for the loss, deletion, or corruption of any data stored on your Device during the fix process.
4. Privacy
By using CellShoppe’s Products and Services, you agree to the terms outlined in the CellShoppe Privacy Policy. This policy may be updated from time to time (the “CellShoppe Privacy Policy”).
You consent to the collection, use, and disclosure of your personal information by CellShoppe and its agents for purposes related to providing the Products and Services. This may include the sharing of your account and usage data with CellShoppe’s affiliated businesses for the purpose of offering services or products that may be of interest to you.
CellShoppe may also offer third-party products and services, which are subject to the third party’s own terms, conditions, and privacy policies.
5. General Terms
a) Limitation of Liability
To the fullest extent permitted by applicable law, neither CellShoppe nor its Affiliates, nor their respective directors, officers, employees, or agents (collectively, the “CellShoppe Entities”) shall be liable to you or any other party for any direct, indirect, special, incidental, consequential or punitive damages, or any other damages or losses whatsoever arising directly or indirectly from your use of the Products and Services (including, but not limited to: defects, malfunctions, or complete breakdowns of any Device; electrical shocks, burns, fires or explosions caused by any Device; loss of profit, loss of earnings, financial loss or loss of business opportunities), regardless of the cause of action, including negligence, and even if one or more of the CellShoppe Entities have been advised of, or could reasonably have foreseen, the possibility of such damages or losses.
If for any reason a CellShoppe Entity becomes liable to you or a third party arising out of or in any way connected with the Products and Services, regardless of the form or cause of action or the number of claims asserted, the aggregate liability of the CellShoppe Entities to you or such third party is limited to the greater of $20 and the fees paid by you to CellShoppe for the particular Products and Services giving rise to the claim, in the three months immediately preceding the last occurrence of the damages or losses.
CellShoppe is not responsible for any cosmetic issues that do not affect the functionality of the Device, such as scratches or scuffs that may occur during fix services.
CellShoppe does not take any responsibility for any progression in damage for Devices that have been damaged by liquid. Although unlikely, opening the Device could initiate further damage and in some cases may be very serious and/or irreparable. We ask our customers to monitor their Device post liquid damage fix as unknown issues can arise soon after treatment for liquid damage which are beyond our control. If issues arise, please contact us and we can reassess the damage. In cases where further fix is needed there may be additional costs incurred.
CellShoppe is not responsible for any loss of function of the Touch ID fingerprint sensor in the case of an Apple iPhone ‘Home Button’ fix.
b) Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify, defend, release and hold CellShoppe, and its Affiliates, subcontractors, suppliers, vendors and licensors, and any of their respective affiliates, shareholders, partners, directors, officers, employees and agents (collectively the “indemnified parties”), harmless from and against (i) all claims, actions, lawsuits and any other legal action brought by any third party against any of the indemnified parties arising in any way from the Products and Services (a “third party action”); and (ii) any and all related losses, damages, settlements and judgments (including payment of attorneys’ fees and costs of any of the indemnified parties) incurred by, assessed or found against, or made by any of the indemnified parties relating to or arising from any such third party action (“third party related losses”), even if such third party action and third party related losses arise from the negligence of any kind or degree of any of the indemnified parties, breach of contract or warranty, strict liability or any other theory of liability. Notwithstanding the foregoing, the third-party indemnification obligation shall not apply to any willful, wanton or intentional misconduct of any of the indemnified parties, or any other wrongdoing where applicable law does not permit indemnification.
c) Termination
You may terminate the Agreement at any time by notifying CellShoppe of the date you want the cancellation to be effective.
CellShoppe may suspend the Products and Services if you contravene any provision of these Service Terms, including your obligation to pay for the Products and Services as charges become due. CellShoppe may terminate the Products and Services (i) immediately and without notice, where CellShoppe determines that the action is necessary to prevent fraud, (ii) if you do not remedy any other breach of these Service Terms within 15 days of receiving written notice of the breach from CellShoppe, (iii) if you become a bankrupt or, if you are a business customer, a receiver or receiver-manager is appointed to manage the affairs of your business, or (iv) for any reason, upon 30 days written notice to you.
d) Arbitration
If you use the Products and Services in the operation of a business, any claim, other than the collection of amounts owing to CellShoppe, relating to (i) your Agreement, (ii) use of the Products or Services or any equipment used with the Products or Services; (iii) sales materials or advertising relating to the Products or Services or any equipment used with the Products or Services; or (iv) relationships with third parties arising through use of the Products or Services, must be referred to private and confidential arbitration before a single arbitrator chosen by the parties. The expense of arbitration will be shared equally. Notice to arbitrate a claim should be sent to CellShoppe, [Insert Business Address Here]. The arbitration will be conducted in accordance with the current rules relating to commercial arbitration in the province in which you reside. Additionally, you waive any right you may have to start or participate in any class action against CellShoppe or its Affiliates and you agree to opt out of any class proceeding against CellShoppe or its Affiliates.
e) Miscellaneous
The federal laws and regulations of Canada, and applicable provincial laws and regulations, govern the Agreement. You may not assign or transfer the Agreement without CellShoppe’s prior written consent. If any provision of these Service Terms is prohibited or unenforceable in certain circumstances, the remaining Service Terms shall apply and be construed in those circumstances as if such provision had never been written. The failure of CellShoppe to require or enforce strict performance of any provision of these Service Terms in a particular instance shall not be construed, in other circumstances, as a waiver of any right conferred upon CellShoppe.
